davemarine.com is a trading name of Sipnav Électronique de Navigation, a company registered in Canada ("Dave Marine", "we", "us", "our"). All orders are fulfilled from warehouses in the United States. By placing an order on this website you agree to the terms below. Please read them before you buy.
1. Ordering and order acceptance
Placing an order is an offer to buy. Your order is accepted, and a contract is formed, only when we dispatch the goods — not when you place the order and not when you receive an automated order-received email. We may decline or cancel any order, in whole or in part, before dispatch, including where an item is out of stock, a price or description is wrong, we cannot verify payment or shipping details, or the order appears fraudulent. If we cancel a paid order we refund the affected amount to the original payment method.
2. Prices and availability
All prices are in US dollars (USD) and are shown on the product page. Prices and availability can change without notice and are not guaranteed until your order is accepted. Product availability reflects our supplier's stock and may change between order and dispatch; where an item becomes unavailable we will contact you and refund it. We try to describe products accurately, but errors in price, specification, image or availability can occur; where a price is clearly wrong we may cancel the affected line and refund it rather than supply at the erroneous price.
3. Payment
Payment is taken through our payment processor at checkout. We do not receive or store your full card number. Submitting payment details confirms that you are authorised to use the payment method. Card statements will show DAVEMARINE.COM.
4. Shipping and fulfilment
Orders ship from warehouses in the United States. Shipping methods, costs, timeframes and the returns process are set out on our Shipping & Returns page, which forms part of these terms. Delivery estimates are estimates, not guarantees. Risk of loss and title pass to you when the goods are delivered to the shipping address you provide — including a freight forwarder's address (see section 5).
5. Freight forwarders, export and international customers
We ship to addresses within the United States, including US-based freight forwarders used by customers outside the US (for example customers in the Bahamas). If you ship to a freight forwarder or other third party:
- Delivery is complete, and risk passes to you, when the goods are delivered to that US address. We are not responsible for loss, damage, delay, mis-shipment, consolidation or handling by the forwarder or any onward carrier after that point.
- You — not Dave Marine — are the exporter of record for the onward shipment out of the United States, and you are responsible for all export compliance, import clearance, and any duties, taxes, tariffs or fees charged by the destination country (including Bahamas customs duty and VAT). These are your responsibility and are not included in the price you pay us.
- Returns and warranty claims run from the original US delivery address. We are not able to arrange collection from, or return shipping to, an address outside the United States.
6. Taxes
US sales tax is applied where we are required to collect it, based on the US shipping address. Any import duties, customs charges or destination-country taxes on goods forwarded outside the United States are the customer's responsibility, as set out in section 5.
7. Returns and warranty
Return eligibility, timeframes and procedure are set out on our Shipping & Returns page. Many products carry a manufacturer's warranty; where they do, warranty service is provided by the manufacturer on the manufacturer's terms, and we will help you start a claim. Except as stated on the Shipping & Returns page or required by law, products are sold as described without further guarantee from us.
8. Product information and fitment
Specifications, images and any technical notes on this site are provided as general guidance to help you choose marine parts and equipment. It is your responsibility to confirm that a part is correct and compatible for your vessel, system and application before you order and before you install it. Any advice or technical note is general information, not a professional survey, installation instruction or certification for your specific boat.
9. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or in connection with any order is limited to the amount you paid for the goods concerned. We are not liable for indirect or consequential loss, or for loss arising from incorrect fitment, installation or use of a product. Nothing in these terms excludes any liability that cannot be excluded by law.
10. Intellectual property
The content of this site — text, images, product copy and layout — is owned by us or our suppliers and may not be copied or reused without permission. Manufacturer brand names and trademarks are the property of their respective owners.
11. Governing law
These terms are governed by the laws of the Province of Québec, Canada, and you agree to the exclusive jurisdiction of its courts, without regard to conflict-of-laws rules.
12. Changes to these terms
We may update these terms from time to time. The version in effect when you place your order is the version that applies to that order. The current version is always posted on this page.
